1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of www.ubella.co.za (the "Website") and your purchase of products, booking of makeup services, and enrolment in online courses offered by UBELLA Academy (Pty) Ltd ("UBELLA", "we", "us", "our"), a company registered in South Africa under registration number 2021/682226/07.

By accessing the Website or purchasing any product, service, or course from us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or our services.

These Terms are governed by South African law, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECT Act"), and apply to all customers, including those purchasing from outside South Africa.

2. Who May Use This Website

You must be at least 18 years old, or be using the Website under the supervision of a parent or legal guardian, to purchase products, book services, or enrol in courses. By using the Website, you confirm that the information you provide is accurate and complete.

3. Products and Online Shop

3.1 We sell makeup and beauty products, including brushes and beauty essentials, through our online shop.

3.2 We take reasonable care to ensure product descriptions, images, and prices on the Website are accurate, but we do not warrant that all information is error-free. We reserve the right to correct pricing or descriptive errors and to cancel any order affected by such an error, in which case you will be offered a full refund.

3.3 All prices are listed in South African Rand (ZAR) unless otherwise stated, and are inclusive of applicable South African VAT where relevant. International customers are responsible for any customs duties, import taxes, or currency conversion fees applicable in their country, as set out in our Shipping Policy.

3.4 A contract for the sale of goods is only formed once we have accepted your order and confirmed payment. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud or stock unavailability.

4. Makeup Services and Bookings

4.1 UBELLA provides personalised makeup services for bridal, formal, informal, and everyday occasions, as well as group workshops, subject to availability.

4.2 Bookings are available Tuesday – Saturday and are subject to confirmation and, where applicable, payment of a deposit. Booking fees, deposit requirements, and cancellation terms will be communicated at the time of booking.

4.3 Cancellations or rescheduling requested less than 48 hours before a confirmed appointment may forfeit any deposit paid, unless otherwise agreed in writing.

4.4 We reserve the right to decline or reschedule a booking due to illness, unforeseen circumstances, or matters beyond our reasonable control, in which case we will offer an alternative date or a refund of any deposit paid.

5. Online Courses

5.1 We offer online, self-paced makeup courses, including the "Every Woman Online Make-Up Course," accessible through our Website.

5.2 Where a course is described as including "lifetime access," this means access for as long as UBELLA continues to operate and offer the relevant course content, subject to these Terms. We reserve the right to update, improve, or discontinue course content, and will provide reasonable notice where a discontinuation affects your access.

5.3 Course content is licensed to you for personal, non-commercial use only. You may not share, resell, reproduce, distribute, or make your course login credentials or course materials available to any third party.

5.4 Our courses are intended for personal skill development and enjoyment. Unless expressly stated on the relevant course page, completion of a UBELLA course does not constitute a formally accredited qualification.

5.5 You are responsible for ensuring you have suitable internet access and a compatible device to access course content.

6. Payment

6.1 Payment for products, services, and courses must be made in full at the time of purchase or booking, through the payment methods made available on the Website, unless a deposit arrangement has been agreed in writing.

6.2 We use third-party payment gateway providers to process payments securely. We do not store your full card details.

7. Intellectual Property

7.1 All content on the Website, including the UBELLA name, logo, course materials, videos, images, text, and graphics, is the property of UBELLA or its licensors and is protected by South African and international copyright and trademark law.

7.2 You may not reproduce, distribute, modify, or create derivative works from any content on the Website or within our courses without our prior written consent.

8. Prohibited Use

You agree not to use the Website to: engage in any unlawful activity; infringe the intellectual property or other rights of UBELLA or any third party; upload harmful code or attempt to disrupt the Website's functionality; or misrepresent your identity or affiliation with UBELLA.

9. Limitation of Liability

9.1 To the maximum extent permitted by law, UBELLA shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of the Website, products, services, or courses.

9.2 Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under South African law, including your rights under the Consumer Protection Act.

9.3 Makeup services and products are provided with reasonable skill and care; however, UBELLA is not liable for allergic reactions or skin sensitivities. Clients are encouraged to disclose known allergies or skin conditions prior to any service, and product ingredient lists are available on request.

10. Third-Party Links

Our Website may contain links to third-party websites, including social media platforms. We are not responsible for the content, privacy practices, or terms of any third-party website.

11. International Customers

Customers purchasing from outside South Africa acknowledge that: products are shipped from South Africa and may be subject to import duties and customs clearance in the destination country; these Terms are governed by South African law regardless of the customer's location; and online course access is provided on a digital basis, unaffected by the customer's physical location, subject to Section 5.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised "last updated" date, and will apply to purchases made after the date of the update.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Website shall be subject to the non-exclusive jurisdiction of the South African courts, without prejudice to any statutory consumer rights you may have in your own country of residence.
